Welcome to VirtSpaces Private Limited (OR) VirtSpaces Pvt. Ltd. (OR) VirtSpaces hereby referred to as “Company” (OR) “we”, (OR) “our” (OR) “us” in this document.

These Terms of Service (“Terms”) govern your access and use of our website, platform, and AI-powered PropTech solutions and all the suite of tools belonging to VirtSpaces Pvt. Ltd. including Foursite, Augmind, Archisculpt and any other tool that might be developed by us (collectively, the “Services”).

By accessing or using our Services, you agree to comply with these Terms. If you do not agree, please do not use our Services.

Eligibility

• You must be at least 18 years old to use our Services.
• By using the Services, you represent that you are legally capable of entering into binding agreements.

Services Provided

VirtSpaces Pvt. Ltd. provides AI-powered visualization solutions that convert architectural floor plans into 3D interior designs and immersive experiences. Additional features may include:

• Customized visualization for real estate and design projects.
• Client dashboards for uploading, managing, and reviewing projects.
• Payment-enabled services for visualization outputs and premium features.

Account Registration

• To access certain Services, you may be required to create an account.
• You agree to provide accurate, complete, and updated information.
• You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.

Payments and Billing

• Our Services may require payment via integrated third-party payment gateways.
• By providing payment details, you authorize us or our payment provider to process charges as per the selected plan or project.

Payment Terms:

• All prices are listed in the specified currency and are exclusive of applicable taxes or transaction fees.
• Fees are non-refundable unless otherwise stated.
• You must ensure sufficient funds/credit are available when making payments.
• We are not responsible for issues arising from third-party payment processors but will support dispute resolution within reasonable limits.

License to Use Services

• We grant you a limited, non-exclusive, non-transferable license to use our Services for personal or commercial purposes related to your projects.
• You may not:
  • Reverse-engineer, copy, or resell our technology.
  • Use the Services for unlawful or unauthorized purposes.

Intellectual Property

• All content, technology, AI models, branding, and visualizations generated remain the property of VirtSpaces Pvt. Ltd. or its licensors.
• Uploaded project content (such as floor plans, photos, or design inputs) remains your property, but by submitting it, you grant us a license to use it solely for providing and improving our Services.

User Responsibilities

You agree not to:

• Upload unlawful, harmful, or infringing material.
• Misuse the Services in ways that could disrupt functionality or infringe on third-party rights.
• Circumvent security or payment features.

Refund and Cancellation Policy

• Refunds are only provided where legally required or explicitly mentioned in Service-specific terms.
• In case of disputes with billing or services, users must contact us within 3 days of the transaction.
• Subscription plans (if offered) can be canceled, but access remains until the end of the billing cycle.

Third-Party Services

• Our Services may integrate with third-party software and payment gateways. We are not liable for failures, errors, or disputes arising from third-party platforms.
• Use of third-party services is governed by their respective terms and policies.

Disclaimers

Our Services are provided strictly “As-Is” and “As Available”, without warranties of any kind.

Due to the probabilistic nature of machine learning, the AI-generated outputs may not be accurate, reliable, or consistent.

You understand and acknowledge that:

• AI-generated results can be incomplete, misleading, incorrect, biased, or even offensive.
• There may be cases of “AI hallucinations” where outputs are fabricated or presented as plausible but are factually wrong.
• The Services are experimental technology and should not be considered a substitute for professional, legal, financial, architectural, or engineering advice.
• Outputs should never be relied upon as the sole source of truth for decisions that carry legal, financial, construction, or material consequences.

VirtSpaces Pvt. Ltd. does not guarantee:

• The accuracy, quality, reliability, or suitability of generated results.
• That the Services will be uninterrupted, timely, or error-free.

Users are fully and solely responsible for validating the accuracy of AI-generated content before using it in any practical, legal, or professional context.

Limitation of Liability

To the maximum extent permitted by law:

• VirtSpaces Pvt. Ltd. shall not be liable for indirect, incidental, special, or consequential damages.
• Our total liability for claims relating to our Services will not exceed the amount you paid to us in the 2 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless VirtSpaces Pvt. Ltd., its affiliates, employees, and partners from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) resulting from:

• Your misuse of the Services.
• Your reliance on AI-generated outputs.
• Your violation of these Terms or applicable laws.
• Actions taken based on potentially incorrect, incomplete, or misleading outputs from our AI systems.

Notice: By using our Services, you explicitly acknowledge that VirtSpaces Pvt. Ltd. is not legally responsible for any consequences: financial, legal, structural, or otherwise, that arise from reliance on AI-generated content. The end-user assumes all responsibility for independently validating outputs before application.

Termination

• We may suspend or terminate your access if you breach these Terms or misuse our Services.
• You may stop using our Services at any time. Termination does not relieve payment obligations already incurred.

Governing Law

These Terms are governed by the laws of India, with jurisdiction in Bengaluru, Karnataka.

Changes to the Terms

We may update these Terms to reflect changes in technology, law, or business practices. Revised Terms will be posted on this page with a new “Effective Date.” Continued use after updates indicates your consent.

At the time of registration (OR) payment (OR) use, you will be required to explicitly accept these Terms and the Privacy Policy. The following statement governs such acceptance:

“I have read and agree to the Terms of Service and Privacy Policy of VirtSpaces Pvt. Ltd. I understand that VirtSpaces’ (OR) Foursite’s (OR) Augmind’s (OR) Archisculpt’s AI-powered outputs are experimental, may contain errors, and must not be relied upon as the sole source of truth. I acknowledge that I am responsible for validating AI-generated content before using it for any personal, business, legal, or material purposes.”

By checking the acceptance box during registration (OR) sign-up (OR) checkout (OR) account creation, you acknowledge and consent to these legally binding Terms.
